Scotland Has Made Environmental Evidence Mandatory for Large Data Centers

From 17 September, every proposed Scottish data center above 50 megawatts requires an Environmental Impact Assessment. The direction converts an emerging set of energy, water, carbon and community concerns into evidence that must shape projects before consent.

Scotland has set a clear environmental-review threshold for a new class of infrastructure. From 17 September 2026, every proposed data center with more than 50 megawatts of power capacity must be accompanied by an Environmental Impact Assessment.

The direction is important for what it changes and for what it does not. It does not prohibit a data center above the threshold. It does not grant consent to one that completes an assessment. It makes the likely significant effects part of the application from the outset, when a developer still has meaningful choices about location, design, power, cooling and mitigation.

That timing responds to the physical character of AI infrastructure. Large data centers are industrial developments with concentrated power demand, construction impacts, cooling requirements, hardware flows and backup systems. The chief planner’s letter identifies potential effects on greenhouse-gas emissions, water resources, biodiversity, soils, landscape, noise and air quality. Fossil-fuel generation would add operational emissions that Scotland’s climate plan has not accounted for. Backup generators can create local air-quality effects even when they are not the main power source.

The 50 MW line removes discretion for the largest proposals. Below it, planning authorities must still decide case by case whether existing environmental-assessment rules require an EIA. Above it, the question has been answered nationally. The threshold therefore creates a minimum evidence floor while preserving scrutiny of smaller projects where location or design makes their effects significant.

The new rule also completes a two-step change in oversight. In August, Scotland required planning authorities to notify ministers of applications for data centers above 50 MW within seven days of validation. That measure created visibility of the national pipeline and its implications for wider infrastructure. The September direction now ensures that those same large proposals arrive with a systematic account of environmental effects.

Together, the directions recognize that a project can be local in planning law but national in resource consequences. A single facility may depend on grid reinforcement, regional water capacity and climate assumptions beyond the planning authority’s boundary. A cluster of facilities can matter even more. Ministerial visibility does not by itself resolve those cumulative effects, but it makes them harder to treat as isolated site questions.

Scotland’s AI strategy points toward the design choices that an assessment can test. It identifies renewable-powered compute, closed-loop cooling, treated-wastewater reuse, careful location and heat offtake as routes to lower impact. It also commits to guidance on what makes a data center genuinely green. None is a universal answer. Closed-loop systems can reduce water demand but still use energy. Heat recovery needs a viable nearby user and a network that can accept the temperature and timing of the supply. Renewable generation does not eliminate embodied carbon, grid constraints or land effects.

An EIA is useful because it requires those relationships to be examined for the actual proposal. The assessment can compare alternatives, identify likely significant effects and integrate mitigation before the project is fixed. It can show whether a claimed benefit depends on infrastructure that is funded, permitted and timed to arrive, or merely appears in a future concept.

The remaining gap is performance. The direction requires assessment; it does not establish a national water-use limit, a carbon-intensity ceiling or a minimum share of recovered heat. Planning decisions will still need to judge the evidence and attach enforceable conditions where appropriate. Periodic review will also matter because data-center technology, power densities and cooling methods are changing quickly.

Scotland’s move is therefore best understood as an evidence rule. It says that a very large data center cannot first be designed as a computing asset and only later explained as an environmental one. The proposal must enter the planning system with both identities visible. The quality test will be whether the assessment changes decisions early enough to improve the project, not whether it adds another document after the consequential choices have already been made.
