England Opens an October Refill Window Without Removing River Safeguards

England has opened a temporary October route for refilling existing irrigation reservoirs outside their licensed season. The change preserves withdrawal limits and river safeguards, so its usefulness depends on local flows, eligibility and careful records.
England’s reservoir refill window adds time to a drought recovery task without promising additional water. From October 1 through October 31, 2026, the Environment Agency’s RPS 382 provides a conditional route for eligible licence holders to fill existing irrigation storage outside their normally authorized abstraction season. It leaves the physical limit in place: rivers must still have enough water for pumping to comply with the applicable safeguards.
A change in enforcement, with the licence still intact
A regulatory position statement explains when the agency will not normally take enforcement action. It does not amend the legal requirement to hold and comply with an abstraction licence. Here, the activity must match the statement, satisfy its conditions and avoid actual or likely harm to the environment or human health.
The distinction gives the October window a narrow purpose. It applies to licences for filling a storage reservoir for subsequent spray or trickle irrigation. It does not provide an open invitation to take water for another use or create a new abstraction point. Holders whose licences already permit reservoir filling in October, or throughout the year, cannot use this route.
That design separates a seasonal timing problem from a wider entitlement problem. An eligible operator may have storage to refill and a licence that otherwise fits the activity, yet be outside its normal season. The statement addresses that mismatch for one month rather than reopening the whole allocation.
Local conditions determine whether the window can be used
Licensed pumping rates and daily volumes remain binding conditions of the statement. So do hands-off flow or level restrictions, the authorized abstraction point and fish or eel intake screening. Existing lawful protected abstractions must not be impaired. Opening the calendar therefore does not open the pump whenever an operator wishes.
The general route also excludes the listed catchments subject to section 57 spray-irrigation restrictions and those classed as Principal Salmon Rivers. Licence holders in these areas may still seek an out-of-season abstraction assessment for their own site. That possibility is separate from eligibility under RPS 382 and should not be reported as a blanket exception.
The agency’s contemporaneous drought report explains why the restrictions matter. Some agricultural storage reservoirs were reported at only 0–20% capacity, creating concerns about winter replenishment. Many rivers nevertheless remained below normal for the season. A depleted store and a depleted river can exist together; need at the reservoir does not demonstrate surplus at the intake.
Notification creates a distinct operating record
Before starting, the licence holder must notify the Environment Agency, providing the abstraction licence number and the holder’s name with RPS 382 identified. The agency says the notification brings the operator into the usual abstraction-alert process for the statement’s duration.
Daily volumes taken under the statement must be recorded, kept for six years and supplied to the agency on request. These volumes must not be included in the annual abstraction return. Keeping the exceptional October activity identifiable is consequently part of using the route correctly, rather than an administrative task to reconstruct afterward.
No charge applies to abstraction under the statement, while the licence’s annual subsistence charge is unaffected. The agency can amend or withdraw the position before its scheduled expiry on November 1. Operators must check that it still applies, and stop and notify the agency immediately if they can no longer comply. The opportunity is additional refill time under defined conditions; how much water it produces remains a local hydrological question.
Take-Out
The extra month is useful only where water can be taken within the surviving river safeguards. Operators should treat the refill window as a conditional opportunity, with its own records and a definite end date.
