Brazil Connects Water Reuse to the Rules That Govern Pollution

Conama has approved three linked national measures covering non-potable reuse of treated sewage, risk-tiered aquaculture licensing and updated effluent controls, joining water supply alternatives to pollution prevention and regulatory information.

Brazil’s National Environment Council has approved three measures that reach different parts of the water system. One establishes national criteria for direct non-potable reuse of treated sewage. A second updates environmental licensing for aquaculture. A third revises the conditions and standards for discharging effluent into receiving waters.

The decisions were taken at council meetings on 1 and 2 September and announced by the environment ministry on 11 September. They are approvals, not evidence that regulated entities have already changed practice. Final legal publication, commencement provisions and implementation by federal and state authorities will determine when the new rules carry operational force.

Seen together, however, they close an important conceptual gap. Reuse is not simply an additional source of water. It changes what leaves a treatment plant, where that water goes, which quality parameters matter and how the remaining discharge should be controlled.

Reuse needs a national floor

The joint Conama and National Water Resources Council measure sets modalities, general criteria and minimum quality parameters for direct non-potable use of treated sanitary effluent from public sewage systems. The intended uses include urban cleaning, irrigation and industrial processes.

A national reference can reduce uncertainty for utilities, municipalities and users that have otherwise depended on uneven subnational rules or project-specific arrangements. It should also make comparison easier: water described as suitable for one use should have passed a recognizable quality threshold and a defined monitoring regime.

Minimum standards are only a floor. Exposure differs between street cleaning, agricultural application and an enclosed industrial process. Storage, distribution, worker contact, aerosols, cross-connections and the reliability of treatment affect risk after water leaves the plant. Local authorization still needs to connect the national categories to the actual pathway of use.

Licensing aquaculture by production

The aquaculture measure changes how projects are classified. Size will be based on production, with small projects eligible for a Licence by Adhesion and Commitment, medium projects for a Single Environmental Licence and large projects remaining under ordinary licensing, subject to the applicable classification.

That is an attempt to match administrative intensity to operational scale. It may reduce unnecessary process for small producers and concentrate detailed review on larger facilities. Production volume alone cannot describe every ecological risk. Species, location, water exchange, stocking density, feed, waste, disease controls and proximity to sensitive habitat still shape potential harm.

The council has specified that the use of exotic species does not, by itself, change the licensing modality. Prevention of escapes and biosafety measures remain required, and environmental monitoring must fit the project’s size and characteristics. The implementation test will be whether simplified licences preserve those site-specific controls rather than treating a smaller production threshold as a proxy for low risk.

Effluent control catches what reuse does not

The third measure updates organic-matter and nutrient controls, extends the approach to new pollution sources and improves monitoring and information management. It introduces differentiated requirements for sanitary-treatment systems of different sizes, including specific limits for ammoniacal nitrogen and total phosphorus. It also addresses urban stormwater as a source of diffuse pollution and gives priority to nature-based approaches for management and treatment.

This is where the package becomes more than three adjacent agenda items. As reuse expands, the volume and composition of residual discharges may change. A treatment plant may divert some effluent to irrigation or industry while still releasing flows to a river. Regulators need mass loads, not just end-of-pipe concentrations, to understand whether pollution has fallen, shifted in time or become concentrated in a smaller discharge.

The same principle applies to information. Reuse quality data, aquaculture monitoring and effluent reports should be usable across the agencies that allocate water, license activities and protect receiving waters. Separate forms that cannot be reconciled will preserve administrative compliance while hiding basin effects.

The package still has to become practice

Conama’s process included public bodies, industry, academia and civil society; the effluent proposal received 699 consultation contributions. That breadth strengthens the rule-making record. It does not settle questions of laboratory capacity, inspection, data publication or coordination among Brazil’s federal, state and municipal institutions.

The first useful evidence will be practical: final resolutions published with clear transition periods; state procedures aligned without weakening the national floor; monitoring templates that preserve comparable data; and enforcement capable of distinguishing a reporting defect from a material water-quality risk.

Brazil has put reuse, productive licensing and pollution control into the same regulatory moment. The opportunity is to govern them as a connected water cycle. The risk is that they return to separate administrative silos after approval.
